I have watched the ongoing trial of a lawyer accused of killing her husband,Ajanaku in Ibadan,Oyo State with dismay hoping that experienced members of the legal profession would comment on this illegality. But I am compelled to comment on this abberration and the unfolding drama. I believe it is highly shameful and illegal that an officer in the ministry of justice which is the prosecuting agency of government would defend a suspect against the state which he swore to work di...lligently for especially,in an offence as heinous as murder while another officer of that same ministry prosecutes the accused suspect. By virtue of provisions of S.211 of 1999 Constitution which highlights powers of the A.G of State and S.4 of Law Officers Act coupled with plethora of decided cases,it is officers in the office of A.G such as Solicitor General,Director of Public Prosecutions that are expected to act in the stead of A.G where there is absence of appointed A.G as we have in Oyo State presently and whatever actions taken by them is deemed to have been done by the A.G because the office of A.G enures in perpetuity. However,in Oyo State today,we have the A.G (Solicitor General or whoever) defending an accused against the State just because he and the accused serve in the same ministry,this is nothing but outright illegality which the family of the deceased victim and conscious members of the public should challenge. The Rules of Professional Conducts specifically Rule 17(4) prohibits such unethical general practice vs family practice becuase it is an obvious case of conflict of interest which may not allow the said counsel discharge his duties dilligent and further contravening Rules 14 and 16 of the RPC. The family of the slain Ajanaku should rather do the needful by praying the court for an order granting them power of private prosecution in order to ensure dilligent and fair prosecution of the matter as seen in Fawehinmi vs. Akhilu (I don't have the citation for now) because at present,it is as if they are dancing on the victim's grave with this trial.
